While I am sorry to read this, I cannot say it was not unexpected. I am only dazzled that the fuel is considered to be a structural part of the airplane (in a marxian sense) rather than a contingent one.
What I mean is that, while aircraft manoeuvrability, armament and structure strength can be considered constant for simplicity, playability (as in: fun) sake, "fuel" represents the various and extremely different initial conditions that can strongly influence the combat outcome.
My only point is that by allowing an _optional_ modification to the amount of "fuel" (that is, energy) the game could be funnier to play, at least for some people, as in: you are in a great fighter, but you are jumped by a single inferior aircraft having more "fuel". You have a short time to dispatch it. Sounds familiar? It is the normal fokker situation . However, why can't this happen to a scout experimental, a bristol or a snipe?
That is: more options (including the original fuel from the rules) = more fun.
Especially one: the game was designed that way, so we must adhere to it. 
What I do not understand is whether this decision comes out of copyright issues or from an ipse dixit approach. I still don't see why implementing a house rule, by specifying it as an option, could be a copyright infringement. Accordingly, most of the "conservative" arguments seemed to stem more from a "I don't want to see any change because the game is good as is" other than "Phil designed the game and will sue our asses out if we change a iota".
