As long as we are not monetizing it, and as long as no one else who might have a claim on the rights to it wants to start their own, then I don't see an issue. We are here to have fun.

To my knowledge we are hosting the very basic edition where the altitude and campaign mode (pilot mode) is missing.

I believe this is the first edition version; it's the same as the original version of the boardgame I bought many years ago.
I believe altitude and campaign rules were part of the 2nd edition rules.
My understanding is that 3rd edition was sort of a step back with fewer planes included. I think that was the version that was being sold last in the US with old reviews still found on Amazon if you do a Google search. If you look on Amazon itself, using it's internal search, you'll find nothing.
The reason I asked if any version was specified in your emails with Phil is that if there's not, then we could probably expand to 2nd edition with altitude and what not and be covered by his permission.
I agree that if we're not monetizing it in any way, we're unlikely to draw any flak from anyone.
