If a ship is sunk it shouldn't hinder your movement.
I see in the rules it says the ship is still afloat. But in my opinion if your hull is completely destroyed the should eventually sink?

According to the original rules, the ship is in such danger of sinking that the crew must devote itself fulltime to preventing that, so the ship surrenders by striking her colors. There was only a small chance that a ship would actually sink or even explode (again, according to the original rules).
As you've seen, it's handled differently here. The ship remains as an obstacle to movement but not guns, an inconsistency others have noted.
So, no, you're not missing anything. It's just something different from the board game that you need to be aware of and adapt to. Hope that helps.
