If there was melee, the ships must've been grappled/fouled to begin with, so a quick transfer back makes sense to me. But if another ship comes along which wasn't just engaged in a boarding action, it again makes sense to me that it would have to grapple.

Agreed, sort of. Billy speaks about grappled ships. Once the ship is empty and not grappled, it doesn't matter who enters it. I still think, an empty ship needs to be treated the same for each player no matter which flag it flies.
Of course, if some of the crew stays back, no grappling is needed any more.
