Here is an inconsistency:
1) My crew captured another ship. Next turn, I was able to return to my now crewless ship (no grappling, no fouling) without problem.

2) My opponent captured one of my ships. Now his original ship was crewless. However, I cannot transfer crew without grappling/fouling.

Both scenarios involve crewless ships, in both scenarios the situation is handled differently.

No inconsistency, this is the common case that you can transfer between your ships without grappling, while you need grappling to capture to enemy ships.
By game rules, crewless ship are not surrendered and do not lose ownership, thus they still require grappling to be boarded.
I agree that it is somewhat confusing here on Youplay as we give score and use the surrender flag when you make an enemy ship crewless.

That makes no sense. How can a crewless ship belong to someone? Ok, for scoring. But it shouldn't be treated differently, it's an empty hulk floating around. Each crew needs to grapple or not but should be treated equally.

I think that was a decision made in the last round of testing, no? Because otherwise, once you captured a ship, if you had to re-grapple your original ship it made capturing way too cumbersome. While your crew is on an enemy ship trying to return most of them home, someone comes along and either blasts you with the prize crew penalty or captures/rakes your original ship. Even if you got them back to your original ship, you had to spend more time ungrappling. It just didn't work.

If there was melee, the ships must've been grappled/fouled to begin with, so a quick transfer back makes sense to me. But if another ship comes along which wasn't just engaged in a boarding action, it again makes sense to me that it would have to grapple.
