For those who know, and those who don't, I have an incurable cancer, multiple myeloma, and have perhaps two years before the dirt nap. The lawyer tells me that might be impossible if I don't defend the IP (intellectual property) rights. So I shall do so to the best of my ability.

I had thought that you had been asked if he could use the game, as he obviously has not then I am sure that he has caused you further discomfort and distress and needs to be sued for that as well.
There's nothing to make someone give up pursuit for IP rights than the thought that they are being personally sued for damages. I'm a professional photographer and defend the rights to my images vigorously as they will be the inheritance I leave behind.
