Assuming the circumstances I listed are all true, then you will definitely get a "scratch". No avoiding that. If only one of the circumstances is different, or the enemy's gun is jammed, then there is no shot despite, perhaps, the appearance of there having been one. So, possible to survive, but not without being heavily damaged.
