I've read the code, Fouling and Grappling orders are based on the coalition currently controlling that ship.
So, a ship of yours (or of one of your allies) captured by the enemy is considered an enemy ship.
An enemy ship captured by you (or your allies) is considered friendly.

Unless you can point me a specific case, I'd say there's no bug in the code.
You'd need to find a case where, for example, you had set:
Unfouling: friendly
and you unfouled with a ship captured by the enemy.
